Hummingbird is an online image compression and conversion service that allows users to compress and convert images in formats including AVIF, WebP, PNG, and JPEG. The Service is available as a free tier and paid subscription plans (Pro and Ultra).

3. Use of the Service

You agree to use the Service only for lawful purposes. You must not:

• Upload images that infringe on the intellectual property rights of others
• Upload illegal, harmful, or offensive content
• Attempt to reverse engineer, hack, or disrupt the Service
• Use automated scripts or bots to abuse the Service beyond normal use
• Resell or redistribute the Service without our written permission

4. Plans and Payments

The Service offers a free tier and paid subscription plans. Paid plans are billed monthly or annually as selected at checkout. All payments are processed securely by a third-party payment provider.

Payments are not refundable except as described in our Refund Policy. Subscriptions renew automatically at the end of each billing period. You may cancel at any time and will retain access to your plan until the end of the current billing period.

You retain all rights to images you upload to the Service. We do not claim ownership of your content. Uploaded images are processed and stored temporarily and permanently deleted within 1 hour of processing. We do not use your images for any purpose other than providing the Service.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience outages. We are not liable for any losses resulting from service unavailability.

7. Termination

We reserve the right to suspend or terminate your access to the Service at any time if you violate these Terms. You may stop using the Service at any time. Upon termination of a paid subscription, access continues until the end of the current billing period.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements. Use of the Service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Hummingbird shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Changes to Terms

We may update these Terms at any time. We will notify users of significant changes via email or a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
